Terms of Service

1. Introduction and acceptance

Welcome to image2ai, an online AI image generation service available at image2ai.cloud (the “Service”), provided by the operator of image2ai.cloud (“we”, “us”). By accessing or using the Service you agree to these Terms of Service. If you do not agree, do not use the Service.

2. The Service and third-party AI models

image2ai lets you generate and edit images from text and images using third-party AI models (for example GPT Image, Nano Banana and Seedream models) that we access through their providers' APIs. Model names belong to their respective owners; image2ai is independent and is not affiliated with, sponsored or endorsed by those companies. Model availability, output quality and speed depend on the third-party providers and may change. AI output can be inaccurate or unexpected, and similar outputs may be generated for other users.

3. Accounts

You must provide accurate information when creating an account and must be at least 18 years old (or the age of majority where you live).
You are responsible for keeping your login credentials secure and for all activity under your account.
Tell us immediately at support@image2ai.cloud if you suspect unauthorised use of your account.
Creating multiple accounts to obtain extra free credits is not allowed.

4. Content policy

You must not use the Service to create, upload or share:

adult, sexual or NSFW content, including nudity;
any content that sexualises, exploits or depicts minors in an inappropriate way;
content that infringes copyright, trademarks, likeness or other rights of any person, including deceptive depictions of real people;
illegal content, or content that promotes violence, hate, harassment, self-harm, fraud or other harm.

Prompts and uploaded images are checked automatically and may be blocked. If you violate this policy we may remove content and suspend or permanently close your account without refund of any remaining credits or subscription fees, and report illegal content to the authorities where required.

5. Your content and ownership

You keep any rights you have in the prompts and images you upload. Subject to these Terms and applicable law, you may use images generated with paid credits for personal and commercial purposes. You are responsible for making sure your use of generated images does not infringe the rights of others. You grant us a limited licence to store and process your inputs and outputs only as needed to provide and secure the Service. The image2ai software, website and brand remain our property.

6. Credits

Credits are a prepaid unit used to generate images on image2ai. Each model and resolution shows its credit cost before you generate.
Credits have no cash value, cannot be transferred or exchanged, and can only be used on image2ai.
Credit-pack credits are valid for 12 months from purchase. Monthly subscription credits are valid for the current billing month. Yearly subscription credits are valid for the current subscription year. Membership cards purchased in CNY are valid for their stated term. Unused credits expire at the end of their validity.
If a generation fails because of a technical error on our side or our provider's, the credits for that generation are returned to your balance.
New accounts may receive free trial credits. Images generated with free trial credits carry a watermark. Images generated with paid credits do not.

7. Prices, payment and subscriptions

Current prices are listed on our Pricing page (USD) and Chinese pricing page (CNY). USD prices exclude applicable taxes, which are calculated at checkout.
Payments are processed by our payment providers (such as Stripe). Card payments may be sold through Link, which then acts as the seller for that transaction and provides transaction support.
Subscriptions renew automatically at the end of each billing period until cancelled. You can cancel at any time; after cancellation you keep access until the end of the current period and will not be charged again.
One-time purchases (credit packs and CNY membership cards) do not renew.
We may change prices in the future; changes do not affect a billing period you have already paid for, and we will tell subscribers before a new price applies to them.
Refunds are handled under our Refund Policy. Please contact us before disputing a charge with your bank.

8. Acceptable use

Do not attempt to bypass content checks, rate limits, credit accounting or security features.
Do not scrape, resell or provide automated access to the Service without our written permission.
Do not interfere with or disrupt the Service or other users.

9. Suspension and termination

We may suspend or close accounts that violate these Terms or harm the Service, other users or third parties. You may stop using the Service and close your account at any time.

10. Disclaimer of warranties

The Service is provided “as is” and “as available”. To the fullest extent permitted by law, we make no warranties about the accuracy, reliability or availability of the Service or its outputs.

11. Limitation of liability

To the fullest extent permitted by law, the operator of image2ai.cloud is not liable for indirect, incidental, special, consequential or punitive damages arising from your use of, or inability to use, the Service. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. Nothing in these Terms limits rights you have under mandatory consumer protection law.
